Maternity or Paternity Leave in Spain

Article 46.3 of the Spanish Workers’ Statute regulates time off for employees to take maternity or paternity leave.  The maximum period provided for this type of leave is about three years from the child’s date of birth.

However, an employee who uses this benefit does not necessarily have to begin to use it from the date of the child’s birth.  The employee may request it at any time as long as the leave occurs within the required timeframe.  In this way, requesting leave well after the child’s birth simply means that the employee will enjoy less time for leave.
