Withdrawal of the lease agreement in Spain

The approval of the 4/2013 Act of June 4, on the relaxation and promotion of the housing rental market measures, amended Article 11 of the Urban Lease Act.

According to the new draft, a lessee can withdraw from a lease agreement agreed to after the approval of the 4/2013 Act of June 4 once six months have passed provided that the lessor receives no less than 30 days’ notice of the withdrawal.

Before the 4/2013 Act of June passed, a lessee had the right to withdraw when the agreed term of the agreement was five years or more, if the agreement had lasted at least five years and the lessor had received prior notice of at least two months.
